The Freedmen’s Marriage Records

of Orange County, North Carolina

Introduction

Among the thousands of ways in which enslaved people were denied their human rights in pre-Civil War North Carolina was the refusal of North Carolina to recognize the validity of marriage involving enslaved people. Slaves were not allowed to obtain marriage licenses, and while a few white churches did allow enslaved people to marry (without legal sanction), many others did not.  Without regard to governmental acknowledgement, many enslaved people “jumped the broom” – conducting their own marriage ceremonies.

After Emancipation in 1865, the new State government of North Carolina soon sought to retro-actively recognize the marriages of formerly enslaved people by allowing them to register their earlier marriages at their county government offices. So in 1866, Orange County began a special book for recording the marriages of formerly enslaved people.  Hundreds of couples soon came to Hillsborough to have their prior marriages entered into this book, the Orange County Freedmen’s Marriage Book.  This book is now safely stored at the North Carolina State Archives in Raleigh. What follows is a summary of the contents of the Orange County Freedmen’s Marriage Book, arranged alphabetically by name.  The original book gives a last name for each of these couples, though by the nature of the situation the maiden names of the wives are not listed in the book.  Enslaved people were not generally permitted to have last names, so the last names listed here are the names that these formerly enslaved people took on after emancipation.  Thus, the brides never had maiden names.

It is interesting to note that in a few cases the marriages recorded here were between one person who was a free person of color and another who was enslaved.  While this was not very common, it clearly did happen to some extent.  It would certainly be interesting to learn more about the circumstances by which such marriages came about.

In a few cases, where I happen to know something more about some of these couples or their descendants, I have included brief notes in [square brackets] after their entry. This record of these marriages is an invaluable tool for people who are interested in the history and genealogy of formerly enslaved people in Orange County.  It is my hope that this short booklet will serve as a resource to future historians and genealogists in understanding the lives of those who were formerly enslaved.

Green Brewer was born a slave in Orange County – presumably enslaved by the extensive Brewer family from White Cross out west of Carrboro. He fell in love with a free woman of color by the name of Nancy. Green and Nancy ‘jumped the broom’ in 1854, but Green was still enslaved. So, Nancy began to scrimp and save in every way she could until she purchased her husband out of slavery. By 1858, Green and Nancy Brewer had saved up enough money to purchase a house & lot in Chapel Hill for $400.[1]

Naturally, Green & Nancy Brewer remained loyal to the United States throughout the Civil War; they were supporters of the Union League – a semi-secret pro-Union political organization. The Brewers support for the Union – behind enemy lines – meant their lives and freedom were constantly in danger. Even after they lost so much to the Union Army, the couple remained staunch supporters of the Union.[2]

Toward the end of the war, in April 1865, the Union Army occupied Chapel Hill.[3] While the Union forces brought emancipation to the enslaved people of Chapel Hill, they also brought thousands of hungry, ill-equipped and desperate men. Some of these men took the Brewer family’s horse, forty pounds of bacon and 1000 feet of lumber – without any compensation to the Brewer’s.[4]  This was the type of thing that happened to many people wherever the Grand Army of the Republic went. The Army took what it needed without compensation.

Green and Nancy Brewer’s loyalty to the Union was tested, but not destroyed. Soon their prominent social position in the African-American community in Chapel Hill and loyalty to the Union earned Green the attention of the Reconstruction Governor of North Carolina, William W Holden. In 1868, Gov. Holden appointed two men of color as Justices of the Peace in Orange County, Green Brewer and Wilson Caldwell.[5] Less than a year later, Thomas Kirby and Green Brewer were elected to the Chapel Hill Board of Commissioners (now Town Council).[6]

Eventually, six years later Congress created the Southern Claims Commission to look into losses suffered by southerners who had loyally supported the United States during the war. By the time this happened, Green had died,[7] so Nancy filed her claim without her late husband. Fortunately for Nancy Brewer (who could neither read nor write), she had the support of an amazing African-American community organizer, who lived just west of Chapel Hill in what would become downtown Carrboro.[8]

With Nelly Stroud Strayhorn’s help Nancy Brewer got her claim filed and paid by the Southern Claims Commission. Nelly testified to the quiet loyalty of the Brewers. As Nelly explained it: “It would not do for colored people to talk here” during the war. Nevertheless they remained loyal because, as Nelly said it was “God’s will for the colored race to be free.”[9]
